They have to take care of a checkbook, pay bills, purchase items, and work in the business. Lawsuits over Titles in Real Estate- The title is what says that you own property. A cloud on a title is when there is a mistake and can cause issues with your ownership. It can even be unpaid taxes from 20 years ago and have been sold several times with the title checked multiple times. Title insurance is usually purchased for the lender and the homeowner and protects you in the event there is a problem. The insurance is only for the amount of the loan. It only covers the lenders loss on lenders title insurance. That is why it is important to have title insurance as a homeowner. Even new homes can have problems. If the builder doesn't pay for the sub-contractors work, then you could find that the sub-contractors come against you and put a lien on your title. The lien could even be filed after the title search and closing has occurred. At the closing table make sure the builder gives you a list of every worker on the property with a lien release on every worker. Also have the builder write a letter stating that he has paid all bills and contractors on the property that you have purchased.
How do I handle Fraud in Title Insurance? Title insurance covers from the moment you purchase your home and back. If you are sued after you close on the property, then title insurance may not cover you. This is a tricky issue. Consider asking for extended coverage on your title insurance to cover you once you purchase the house.
I am in a larger home and downsizing, do I rent my larger home or sell but at a loss?- Being a landlord is a big feat. It can be a wonderful option but only for certain people. Can you make the house payment if there is not a tenant or the tenant doesn't pay the rent? Can you handle paying and taking care of expenses on repairs and maintenance, even on the weekend when you will have to pay extra for repairs? Tenants will not leave your home neat and clean and perfect when they leave. You will have to clean and even pay for repairs or new flooring and paint. If you can handle all of these things, then consider becoming a landlord. Other factors to consider is whether the house is paid off? Putting a tenant in the property, can cause a loss of market value and issues when selling the property later.
