Avoiding Conflicts When Building and Remodeling- There are many conflicts that can be avoided when building and remodeling. Many conflicts occur between the general contractor and the sub-contractors. Sometimes the sub-contractor will put a lien on your home when the conflict may be against the general contractor. Make sure that all details are worked out in a contract. Don't assume that it will be okay. For example, if the sub-contractor leaves extra supplies and trash around and the g. contractor hires someone to clean up and charges the sub-contractor who in turn doesn't agree with the charges. A conflict occurs. When it comes to filing a lien, there is a 30 day limit after the last day worked. As a buyer, ask for a lien release from every sub-contractor when you go to closing. It may be difficult to obtain but would provide a great deal of safety for the homeowner/buyer. Also get an affidavit from the builder stating that they have given a complete list of all the sub-contractors with lien releases.
A good builder is a builder that doesn't have to build another house. A good builder will not have to use the money from a previous transaction or build in order to start your home. Some builders will have to use the money from one transaction to start and pay for the next one. If a problem arises and you are the last home they build, you could end up with an unfinished home if sub-contractors and suppliers begin to place liens to obtain their money.
Make sure that before you put a builder under contract when you are building or remodeling, make sure that everything is laid out in the contract. Don't leave things out and assume that there won't be any problems. Consider how you want a dispute to be handled? Who will pay for what?
Remember to hire an agent that has lots of experience with building, working with builders, and when to talk to an attorney, so that you can avoid may of the pitfalls and problems that can arise with building and remodeling.
